In this section Criminal Defence Lawyer Chirag Patel shares some of the exceptional results he is proud to have supported clients with.
Chirag's criminal defence client was found not guilty of an allegation of domestic assault on his ex-partner following an argument they had while she attended his address to collect their child.
Chirag's client stated that he was acting in self-defence when he was assaulted first, and was defending his property when she refused to leave his home.
The Magistrate agreed with Chirag's submissions that the prosecution had failed to prove beyond reasonable doubt that the accused person was not acting in lawful self-defence of himself or his property.
Chirag's tenacity and perseverance paid off on behalf of his client who faced serious disqualified driving matters, including having allegedly failed to stop for police, resulting in a police pursuit.
Chirag was able to demonstrate that the prosecution could not prove the identity of the driver from CCTV footage beyond reasonable doubt.
After lengthy negotiations with the Police Prosecutor, it was agreed that all charges would be withdrawn.
Chirag represented the first ever Aboriginal clients whose cases were heard in the Koori Court at Wodonga Magistrates' Court (2022).
Chirag's clients had never been in trouble with the law and were both very nervous at the prospect of facing the Magistrate and respected Elders from the local Indigenous community.
Chirag was able to expertly and empathetically reassure his clients as to the procedure on the day and what to expect. He remained with them throughout their hearing, putting their minds at ease.
Both clients received Adjourned Undertakings (a Good Behaviour Bond) without conviction and were extremely pleased with the result.
Chirag acted as the criminal defence lawyer for Mr W. He had pleaded guilty to serious domestic violence offences and was at risk of jail. Chirag successfully persuaded the Magistrate not to send him to jail, and instead have him assessed by a forensic psychiatrist to explore underlying mental health issues and PTSD from the 2019 bush fires.
Mr W received a Community Corrections Order and Chirag was further able to persuade the Magistrate exceptionally not to record a conviction against him, ensuring that his future job prospects were not jeopardised.
Chirag acted as the criminal defence lawyer for this client and successfully argued in the course of legal argument, using supporting caselaw, that his interpretation of the applicable law was the correct one to follow, The Prosecutor tried to argue a different interpretation of the law.
The Magistrate ultimately agreed with Chirag's legal argument and ruled in Chirag's client's favour.
